Terms of Service

1. Agreement to Terms

By engaging David Claude Landscape Design for landscape design or construction services, you agree to be bound by these Terms of Service and any specific contract terms agreed in writing for your project.

2. Services

David Claude Landscape Design provides landscape architecture, design and construction services across Melbourne's north-east, including but not limited to:

  • Sloping block landscaping (design and construction)
  • Pool landscaping and surrounds
  • Engineered retaining walls
  • Premium paving and driveways
  • Garden lighting design and installation
  • Landscape design consultation and documentation

3. Engagement and Quotation

All engagements begin with a paid on-site consultation. Following the consultation, we provide a written fee proposal for the design stages. Construction quotes are provided after design documentation is complete. Quotes remain valid for 60 days unless otherwise stated.

4. Pricing and Payment

All prices are quoted in Australian dollars (AUD) and exclude GST unless otherwise stated. Design fees are billed against milestone deliverables. Construction work is billed progressively against agreed payment milestones. Payment terms will be specified in the project contract.

5. Cancellation Policy

Design-stage engagements may be cancelled at any time, with payment due for work completed to the cancellation date. Construction contracts include cancellation provisions specific to each project, balancing client flexibility with material orders, subcontractor commitments and team scheduling.

6. Warranties

David Claude Landscape Design warranties cover:

  • Hard construction (retaining walls, paving, decking, drainage) for structural defects, with terms specified in your project contract
  • Plantings under an establishment guarantee subject to the agreed maintenance schedule and seasonal conditions
  • Lighting fittings as per the manufacturer's warranty, typically 5–10 years

Warranties exclude damage from third-party works, neglect of recommended maintenance, weather events outside normal seasonal conditions, and modifications to the work after handover.

7. Council Permits and Approvals

Where the project requires council permits (building permits, planning permits, BMO compliance, tree-removal applications), we coordinate the application as part of the project documentation. Council fees are passed through at cost. Construction does not commence until permits are issued.

8. Limitation of Liability

David Claude Landscape Design shall not be liable for indirect, incidental, special or consequential damages arising from the design or construction work, except where required by Australian Consumer Law. Total liability is limited to the value of the engagement.

9. Intellectual Property

Design drawings, plans and documentation produced by David Claude Landscape Design remain our intellectual property and are licensed to the client for the construction of the specific project they were produced for. Reuse of designs on other properties without written consent is not permitted.

10. Changes to These Terms

We may update these Terms of Service from time to time. Changes apply to engagements entered into after the date of the change. The updated date at the top of this page indicates when the terms were last revised.
